The Environment (Legislative Functions from Directives) (EU Exit) Regulations 2019

This instrument transfers a series of legislative functions that are currently conferred by European Union (“EU”) Directives upon the European Commission (“the Commission”), to be exercisable instead by public authorities in the United Kingdom (“the UK”), so that they can be exercised at national level after the UK leaves the EU. The EU Directives concerned relate to a number of environmental policy areas: air quality, environmental noise, infrastructure for spatial information, marine and water quality.


The Explanatory Memorandum to the regulations states: ‘This instrument and the policy reflected in it have been developed in collaboration with the Devolved Administrations.
