Dear Secretary of State,

Please find enclosed a written notification which seeks to prevent Regulation (EU) 2026/2108 of the European Parliament and of the Council of 16 September 2026 establishing the Union Customs Code and the European Union Customs Authority, and repealing Regulation (EU) No 952/2013 from applying under the Windsor Framework.

The written notification, which was provided to me on 5 November 2026, has been agreed by those Members of the Northern Ireland Assembly who are listed overleaf.

I am satisfied that the conditions in paragraph 11(2) and (3) of Schedule 6B of the Northern Ireland Act 1998 have been met.

I shall now publish this written notification in line with my duties in paragraph 13 of Schedule 6B.

I am copying this letter, and the written notification, to all Members of the Assembly.
