This instrument is being made using the power in section 8 of the European Union (Withdrawal) Act 2018 in order to address failures of retained EU law to operate effectively or other deficiencies arising from the withdrawal of the United Kingdom from the European Union. The instrument amends domestic legislation that implements EU air quality legislation to ensure it continues to be operable after the withdrawal of the UK from the EU.
The EM states that the Devolved Administrations were engaged in the development of the instrument and are content with the instrument.
